Proviso—Whether insurance company is under statutory obligation to cover all
kinds of employees?—Held, no—On a reading of the proviso to Sub-Section (1) of
Section 147 of the Act, it is demonstrable that the insurer is required to
cover the risk of certain categories of employees of the insured stated therein—The
insurance company is not under statutory obligation to cover all kinds of
employees of the insurer as the statute does not show command—That apart, the
liability of the insurer in respect of the said covered category of employees
is limited to the extent of the liability that arises under the Workmen
Compensation Act, 1923.
